1. General conditions

1. By commissioning me, you are agreeing to the Terms of Service below. I, the artist, am not responsible if the client fails to read the given Terms of Service provided.
2. I am against NFTs and AI. I won’t do any commissions related to NFTs/AI. Selling or using my work as an NFT/AI is against my TOS.
3. I reserve the right to refuse any order request.

2. Payment

1. All payments are upfront in full through the agreed platform
2. Payments to proposals should be paid fully within 2 weeks or will be declined
3. A Non-Disclosure Agreement (NDA) fee of 10 Euros applies if you request that I do not post your commission publicly or use it as part of my Portfolio
4. Complexity Fee is between 10-100 Euros for all commissions
5. If a commissioner wishes to buy Commercial Use after a commission, the price will be:
   1. Streamer Commercial Use: 25 Euros
   2. Merchandise Commercial Use: 30% of final price
6. Payments cannot be refunded.
   1. Exception: I cannot start the commission and cancel the commission on my own terms.
7. Rush-Fee

8. Unless not stated otherwise, my hourly rate is 40€ (Euros).

Paypal & Ko-fi specific:

If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.

If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all before-mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

3. Revisions

Revisions are only available during the sketch phase. Once sketches are approved, no further changes will be made unless due to error on my part. Mistakes I make will always be corrected at no cost.

1. Price includes two free revisions. The revision will automatically be used after I finished the sketch/concept.
2. Every other revision will cost an additional +10% of the total price and must be purchased beforehand.
3. If you wish for me to change something you have previously approved, I will charge you a fee to change it. The amount of the surcharge depends on the change you want me to make and is usually based on an hourly rate. </aside>

4. Process & Delivery

1. We discuss what you want your drawing to look like.
2. We discuss the deadline.
3. I start drawing the sketch/concept.
4. I send you the sketch/concept for review.
5. Optional: You can make use of your included free revision here.
6. You pay (including any additional fee’s for reviews or rush fee)
7. I start drawing the Line Art.
8. I send you the Line Art.
9. If everything looks fine, I will start coloring and shading.
10. I deliver the final drawing to you via Email.

5. Deadlines & Delivery

Delivery times depend on the artwork, in general it takes me up to 4 weeks to finish a project. Delivery times are approximate, I reserve the right to delay delivery. This can have various reasons such as: complexity, queue, health, work, quality assurance, mental health, art block (= creative block), or personal matters. If something changes in the schedule, I will communicate this immediately and let you know. Rush-Fees: If you wish to skip the queue, an additional surcharge of 50% of the final price prioritizes your commission. You will have to directly message me or state before I start the sketches.

6. Intellectual Property Rights

1. I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.
2. I will not claim the intellectual property (IP) of the commissioned artwork (your characters are still yours, etc.).
3. I may use the artwork to:
   1. Promote myself and my services.
   2. Post on social media and in my portfolio as well as in publications such as art books (I can delay a posting if the commission is a gift).
4. I will not profit further from the commissioned artwork unless you (the customer) break any of the terms. </aside>

7. Usage Rights

You, the commissioner, may:

• retain the rights to the intellectual property (IP).
• use this artwork for personal purposes only (unless commercial rights are purchased)
• distribute, remix, adapt, and build upon the material in any medium or format, for noncommercial purposes only. If you modify or adapt the material, you must give credit to the artist (me).
• upload the commissioned artwork on any website and social channels with credit to me @voidedmain

You, the commissioner, may not:

• use the artwork commercially without permission
• use artwork purchased for personal use to make profits or use in commercial purposes (reselling, redistributing, uploading to POD-services, making prints for selling, streaming/video content, commercial projects, etc.)
• AI/NFT use is strictly prohibited. My work may not be used in AI datasets, engines, or minted as NFTs
• Commission art/services using my design/works
• claim the artwork as your own or fail to credit me
• Remove signatures/watermarks
• Resell or redistribute the artwork </aside>

8. Blocklist Policy

Breaking these rules may result in you getting added to my permanent blocklist. The blocklist may be shared with other artists.
